Under B.C.’s Workers Compensation Act, employers have important obligations to workers who are affected by a workplace injury, mental disorder, or occupational disease. These include a duty to cooperate with workers and WorkSafeBC in supporting an early and safe return to work, as well as a duty to maintain employment in certain circumstances.
In this video, lawyer Glen Stratton explains the duty to cooperate and duty to maintain employment, including employers’ obligations to maintain communication with workers, identify suitable work, provide information to WorkSafeBC, and, where required, offer pre-injury work or alternative work with comparable wages. Glen also discusses employers’ obligation to accommodate workers to the point of undue hardship by making necessary changes to the work or workplace.
