Who is Not Covered by the Employment Standards Act BC

The Employment Standards Act covers most employees in BC, but there are some exceptions. The following groups of employees are not covered:

That said, the collective agreement must still meet or exceed the requirements created by the Employment Standards Act, so unions must ensure that this is the case for its member and that those standards are followed.

Independent Contractors and Professionals

Independent contractors and certain professionals such as doctors and lawyers, are not covered by the Employment Standards Act. Instead, their employment standards are governed by their contracts and the laws that apply to their professions.

Specific Industries

Some industries in BC, such as farms and oil and gas, have specific exemptions from certain parts of the Employment Standards Act. Employers in these industries must ensure that they are aware of these exemptions and comply with the standards that do apply.
